On this page
These Terms of Service (“Terms”) apply when you use the ShopOpsy website at www.shopopsy.com and when you order a legal page service from us. They also apply to our Shopify apps, alongside Shopify’s terms, as described in Our Shopify apps.
1. Accepting these terms
By using the website or ordering a service, you agree to these Terms. If you don’t agree, please don’t use the website. Our Privacy Policy explains how we handle personal data.
If you use the website or order a service on behalf of a business, you confirm that you’re authorized to accept these Terms for that business. In that case, “you” means both you and the business.
2. Who we are
The website is operated by ShopOpsy (“ShopOpsy”, “we”, “us”). We build apps for Shopify merchants and draft policy pages for Shopify stores. You can contact us at hi@shopopsy.com.
3. Using the website
You may use the website to learn about our apps and services, read our guides, contact us and place orders. When you use it, you agree not to:
- Break any law or infringe anyone else’s rights
- Try to gain unauthorized access to the website, its hosting or our accounts, or interfere with their security or operation
- Use bots, scrapers or other automated tools to copy content at scale or to submit forms
- Send spam, malware, or abusive, misleading or unlawful content through our forms, email or chat
- Pretend to be someone else or misrepresent your connection with a business
We may change, suspend or remove any part of the website at any time, and we don’t promise that it will always be available.
4. Content and intellectual property
The website and its content, including text, guides, graphics, design and the ShopOpsy and Cookify names and logos, belong to ShopOpsy or its licensors and are protected by intellectual property laws.
You may view and print pages, and share links to them, for your own use or your business’s internal use. You may not copy, republish, sell or adapt our content without our written permission, except where the law allows it, such as quoting short passages with attribution.
If you send us ideas or feedback, we may use them to improve our products and services without any obligation to you.
Shopify and the Shopify App Store are trademarks of Shopify Inc. ShopOpsy is an independent developer and isn’t affiliated with, endorsed by or sponsored by Shopify. Other names and logos on the website belong to their owners and are used only to identify their products.
5. Our Shopify apps
Our apps, including Cookify, are installed and managed through the Shopify App Store once they’re available there. When you install one of our apps:
- Your use of Shopify, including the Shopify App Store, is governed by Shopify’s terms.
- Your use of the app is also subject to its privacy policy and to any separate terms we publish for it on its App Store listing or its page on this website. Where an app has no separate terms, as is currently the case for Cookify, these Terms apply to your use of it. For Cookify’s data practices, see the Cookify Privacy Policy.
- Paid plans are billed by Shopify on your Shopify invoice, under Shopify’s billing terms. Plans, prices and free trials are shown on the app’s pricing page and in the app.
Our apps are tools that help you run your store. They don’t make your store compliant with any law on their own, and you remain responsible for how you configure and use them. The Content and intellectual property, Disclaimers, Limitation of liability, Governing law and disputes and General sections apply to our apps as they do to the website, and references there to the website include our apps.
Descriptions of our apps on this website reflect them at the time of writing. If they differ, the app itself and its App Store listing take priority. Apps marked as in development may change before release, or may not be released.
6. Legal page services
What the service is
We draft policy pages for Shopify stores, such as a privacy policy, cookie policy, terms and conditions, refund and return policy and shipping policy, based on the information you give us in the order form and a review of what we can see on your store. We rely on your answers for anything we can’t see. Each service page describes what’s included and its price.
Our legal page services are for businesses. By ordering, you confirm that you’re ordering for your store or another business purpose, and not as a consumer.
Not legal advice
Our legal page services are a drafting service. ShopOpsy isn’t a law firm and doesn’t give legal advice, and ordering a service doesn’t create an attorney-client or any other professional relationship. We don’t check whether your store complies with the law. If you need legal advice, talk to a qualified lawyer where you do business.
Your responsibilities
You’re responsible for:
- Giving us accurate and complete information, and having the right to share it
- Reviewing the documents before you publish them, and making sure they match how your store actually works
- Publishing the documents on your store and keeping them up to date when your business, your apps or the law change
Ordering and payment
You order a service through the order form linked from its service page. Prices are one-time fees in US dollars (USD), as shown on the service page when you order. Prices don’t include taxes unless the order form says otherwise. Payment is processed by the payment provider used in the order form, and we don’t receive or store your card details. Your order is accepted when you submit the order form and your payment is completed.
Delivery
We deliver your documents by email to the address you give in the order form. If we need more information to complete them, we’ll contact you, and delivery may wait until you reply.
Using the documents
Once you’ve paid, you may use, edit and publish the documents for the store named in your order. You may not resell them or offer them to others as templates.
Refunds
If we can’t deliver a service you’ve paid for, we’ll refund the full amount. If you cancel before we start drafting, we’ll refund the full amount. Once we’ve sent your documents, the fee isn’t refundable, but we’ll correct anything that doesn’t match the information you gave us. To ask for a refund, email hi@shopopsy.com with your order details. This doesn’t limit any rights you have under mandatory consumer protection law.
7. Guides and other content
Our guides, articles, FAQs and other content are general information. They aren’t legal, tax or other professional advice, they may not reflect the latest changes to Shopify or the law, and they may not fit your situation. Check official sources and get professional advice before you rely on them.
8. Third-party links and services
The website links to, and uses, services run by others, such as Shopify, tawk.to (live chat) and Tally (forms). We don’t control them and aren’t responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.
9. Disclaimers
To the extent permitted by law, the website and its content are provided “as is” and “as available”. We work to keep the website accurate and running, but we don’t promise that it will be uninterrupted, error-free or complete, or that it will meet your needs. Nothing in these Terms excludes any warranty or right that can’t be excluded by law.
10. Limitation of liability
To the extent permitted by law:
- ShopOpsy isn’t liable for indirect or consequential losses, or for loss of profits, revenue, data, goodwill or business opportunities, arising from the website or our services.
- Our total liability for any claim related to a legal page service is limited to the amount you paid for that service. For any claim related to one of our apps, it’s limited to the amount you paid for that app in the 12 months before the claim, or USD 100 if that’s higher. For any other claim related to the website, it’s limited to USD 100.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that can’t be limited or excluded by law. If you’re a consumer, these limits don’t affect your mandatory legal rights.
11. Indemnity
If you use the website or a service for business purposes, you agree to compensate ShopOpsy for reasonable losses and costs, including reasonable legal fees, that result from your breach of these Terms or from information you gave us without the right to share it. This applies only to the extent permitted by law.
12. Suspension and termination
You can stop using the website at any time. We may suspend or end your access to the website, or refuse or cancel an order, if you breach these Terms or if the law requires it. If we cancel an order before delivering it, we’ll refund the full amount.
Sections that by their nature should continue to apply after termination, such as those on intellectual property, disclaimers, limitation of liability and governing law, will do so.
13. Changes to these terms
We may update these Terms from time to time, for example when we add services or the law changes. We’ll post the new version on this page with a new “Last updated” date. Changes apply from that date and don’t affect orders placed before it. If you keep using the website after a change, the updated Terms apply to you.
14. Governing law and disputes
These Terms are governed by the laws of the country where ShopOpsy is established, without regard to its conflict of law rules.
If you’re a consumer, you also keep the protection of the mandatory consumer protection laws of the country where you live, and you may bring a claim in the courts of that country.
If you have a problem, please contact us first. Most issues can be resolved by email.
15. General
These Terms, together with the service page of any service you order, are the entire agreement between you and ShopOpsy about the website, our apps and our legal page services. If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a provision straight away, we can still enforce it later. You may not transfer your rights under these Terms without our consent. We may transfer ours, for example as part of a sale of our business, as long as your rights aren’t reduced.
